Interim EAD Procedures

I have another question , this is pertaining more to my wife than to myself . I need to get her an SSN right after I get my I-EAD card . Can I go directly to the SSN office right after getting my EAD card .. Will the card say that she is " Authorized to Work " .

90 days rule

I would like to verify this, my understanding is after we apply for the EAD and we waited 90 days . If INS doesn't give us a respond we will eligible for the interim EAD. I also saw this rule once on INS web site. How could they turn us away and only provide interim EAD AFTER current one expired AND our application already submited for more than 90 days. I know that many employer is very strict and they WILL fire us the same day that our EAD expire. Could some one help me on this

The basic problem is that each level of the USCIS is a law unto itself, and the local offices won't necessarily follow a rule just because they are supposed to.

I know for a fact that all the local offices within the area covered by TSC were sent a memo from the TSC directory requesting them to issue iEADs after 90 days. I did have a copy of this memo somewhere, but unfortunately I can't find it. However, this didn't stop the Dallas office turning me away and telling me to come back after the card had actually expired.

I was in a similar situation to you in that I work for a large company that officially will not bend the rules at all. My EAD expired on a Sunday and the Dallas office decided to close without telling anyone on the Monday, so I couldn't go until the Tuesday and they then gave me an iEAD card dated from the Wednesday. The I9 processing people in my company told me that I would need to take leave of absence. However, when I explained the situation to one person within the department, she agreed to bury the paperwork under a pile on her desk for a few days to give me some grace until I got the new card. Therefore, I would suggest that you see if there is anyway your employers might bend the rules a bit to help you out without incriminating themselves.
