Thought I could share this with you all..

Current Status: Applied for adjustment of status

I140 Pending (receipt Aug 5th)
I485 pending (Concurrent Filing)
AP pending (reciept Aug 5th)
EAD Penging (recievpt Aug 5th)

Visited San Jose Center this morning at 5:45 am.
About 25 people ahead of me in line. Heard
Tuesdays and Wednesdays are best to go for
short wait times.

Lines start to get long after 6:15 am. About 150-200
people by 7 AM.

Token issued at 7:20: asked about I140 approval,
I485 notice and I765 (EAD) notice. Since I didn't have
I-140 approval the person at token counter said the
chance was that I may not get the EAD.

My nuber called in around 9:30, basically same papers
were requested, she checked the current status of
all the 3 applcations(I-140,I485,I765), and stamped
approved interim EAD for 8 months. Btw, I had to file
another I765 for her.

No fee was needed to be paid. They do a background check
I think. Also dont forget to put the Alien number in the new
I765 application.

Took picture and out in 30-45 mins.

Same experice for my wife, who is my dependent.

COngrats. BTW quick question, which Service Center are your 140/485 etc originally filed?? Is it CA or elsewhere. Please let me know.

did they ask any thing about I-94??
Do we need to fill the I-765 form, (like which we already sent BCIS)!!!

How did you know there was a background check, and what does it mean?
did you they took the picture(ADIT photos), or we need to bring with you us?

Originals were filed in CA.

They take pic, so we dont need to carry any.
Yes, had to file new I765 same as old only had to
add "A" (alien) number.

Background check not status related I guess,
more to do with criminal records (my guess).
They approved it first and then asked me to go to
fee counter to get stamped(zero fee). And the
cashier told me they do some background chck before
they stamp. Following which they take pics and give
the EAD.

I have a question on emergency AP at San Jose office.
I heard that for eAP, I have to drop the materials in the "drop box" in front of building - cannot see the officer, is that true? Also do you know if approval of eAP, cat get it at the same day? Thanks.

It's more than 90 days now for my wife's EAD approval. Got a RFE 2 weeks back and the Lawyer sent the reply to INS. INS have received the reply from the lawyer.
1. Can my wife still go to the local INS office for interim EAD..?
2. If they approve it, how long will the i-EAD last ?

Hi,

I dont know about the AP. There was a one page letter on
the wall which I read while waiting to get the picture taken.

The letter says, due to 9/11 there could be backgground checks
on AP and Interim EAD which could make the process take about
2-4 weeks. Having said that my IEAD was done the same day
so was the case for many others.

I dont know the procedure for AP, but there was a drop box
out side the building. Actually, I am in the same boat, I was
planning a vacation but need the AP, and there is no signs
of AP moving forward from May in CA service center.

About the I EAD, I think they can process if the case has not
been started processing, if the case is in the middle of processing
my openion is they wont do the IEAD. In any case check with
the lawyer.

Btw, the I EAD is for 8 months. If in the mean time the original
EAD application get approved it will be for 1 year from date of
approval.
