Interesting Situation

Hi,
My OPT expires on April 2,2007 and I am currently working in New york. My employer missed the H-1 quota and the earliest I can apply for H-1is April 1, 2007. I then have a 2 months grace period that enables me to stay in the US till end of May 2007. So is there any other visa that I can apply for so that I can work from June 2007 to Oct of 2007?
 
You cannot work if your OPT expires and your H1 isn't approved yet.

Unofficially you can work from home OR work something out with the employer that pays you. Once you are under your H1B then can work officially. Obviously, this is a little bit shaddy.
 
Hi,
What if they file for the H-1 on april 1 and do the premiium processing. In that case I should have an approval by say april 20,2007 and I will still be in the OPT grace period. I understand that the H-1 starts on october 1, but do things change with the premium processing process? Is it then possible for me to stay legally in the US?
