My I-140 was approved under EB-1 Outstanding Researcher and Professor category. I now have a pending I-485 with fingerprinting done, and my H1B
is valid until 2005. Would it affect my 485 petition if I were to take up a position in an Australian University as a Visiting Professor or Fellow for 6 months to a year? During that period I will be on unpaid vacation but still on payroll from the sponsoring US University, and the pay will resume once I return to the US. If that is okay, how do I respond to an RFE from the INS in case there is one? Also, what happens if the 485 is approved while I am outside of the US? Any reply would be appreciated.
