Interesting Name check experience at InfoPass

Today I had been to Infopass appointment and I found that my name check is pending from FBI, initiated Sept 2005. My wife (she was not born in India but raised in India) also did a status search today but her name check is cleared from FBI. We came to the US together around the same time and lived together throughout the US for the last 8 years or more. My wife and I also have the same last names right after our marriage. If it is a name check, how come a person with same last name from a different country gets cleared and other does not.

The following theories are not valid.

1. Last name seems to have an effect.
2. Number of states you lived in the US and how long you lived.
3. Only islamic names have issues.

Now, I have every reason to believe that this process is very unreliable and it could easily be used a backlog elimination process by uscis. I just have to just wait for its day ?
 
Just an example of possible scenario. FBI software found some hits on the last name. Deeper analysis, made by a FBI analyst, showed that your wife's gender/DOB/first name was a way too far from the "suspects" on FBI files. So, she has been cleared. Your case required additional analysis, so it was put in line, because USCIS requires FIFO processing order from FBI or because more experienced analyst would have to work on such type of cases or any other reason, which you can think of.

Gender and Nationality can be valid filters. Our DOBs are close and our last name is very uncommon and combined with my first & middle it is almost unique. Wish they had spent little more time in doing the same deeper anlysis at my name. What a strange coincidence to end up with many indians stuck in name check at time uscis is trying its best to distribute 2800 India eb2 visas through out the year.
 
Well, unique or rare last names definitely pass though the checks faster. However, FBI software also checks "similar" names, which obviously makes the entire process longer. Even if your first+middle+last name combination is unique, there might exist "similar" one, which is more common.
I'm just wondering, don't you consider filing WOM against USCIS?

To add even more confusion to the "theories":
I went to infopass about a year ago to find out about the name check. Was told that everything is clear and i'm ok. When in May(?) i called VSC (back then you could talk to VSC directly and not with customer service that seem to know nothing) i was told that my namecheck is pending. I wouldn't trust the infopass information.

Sometimes, they misinterpret the terms. For example, you name check might be cleared, but background checks might still be pending, since name check is just a part of background checks.
Just a thought.

Which field office did you go to and where is your I-485 pending?

I went for an infopass apointment at NY City field office 2 days back to check on my I-485 pending for over 2 years now at VSC and was told that since my application is at VSC they have no information about it and I will have to write to VSC to get its status. I had my I-140 EAC number which they confirmed was mine but could not tell me the specific priority date.. said it only says that it is 2001 and when I asked if I could have a copy of it. I was told to write to VSC for that too.

Is WOM the medicine for everything ?

The current followup is for WOM before I get too tired otherwise I would not even do these enquiries, infopass, congressman..... There has to be some initiative that needs to come from the uscis to fbi after certain time. I am thinking that uscis just keeps ignoring these cases as they don't have many indian visa numbers anyway. So, this boils down to being slower name checks when less visa numbers or whatever... This could be the reason why more indian eb2 namecheck stuck guys are hanging around every tracker compared to the number of row eb2 name check stuck candidates.

I am just hoping that I don't end up like last year when they consumed all the visas in the first six months. WOM preparation would be of no use then.

excalibur, I think your PD has to be current to get info about FBI namecheck.

Suggested names

Would-be immigrants should have names like:

Xirquiteyyshf Ujjdkwjfujelkcj Niriewdnannjhdjjehh

to go through the name check quacgmire within 2 days flat.

People with such names would also earn respect from FBI ("man .. how does
he / she know how to spell the name?")

My last name is common (not Garcia or Patel or Smith) and I am sure some dude who shared my last name must have been in FBI's most wanted 100,000 list in the 20s or 30s .. and I was made to suffer for 30 months. My biggest offence in this country? A traffic violation!

because of these namecheck issues and delays, would you recommend going thru the Consular Processing?

this is my second attempt at GC. during my first gc application, i applied via CP and my process was complete and my file was at the consulate in 3 months except that PD wasn't current so i never got an interview and i don't think i'll ever get an interview because of the eb3 category retrogression.

this time i've filed under eb2 category and now i am wondering if i still need to go thru the CP process again rather than going the I-485 route? Note that my PD is current under EB2 category.....
