I have a very good and interesting case that I need some opinion on.

My father filed an I-130 on my behalf in 04, when he received his greencard. He is eligible to receive his citizenship now; however, due to financial constraints, he is unable to file for citizenship at this time.

The priority date on my I-130 has just become current. My mom is a US citizen and she is willing to file an I-130 on my behalf.

My question is: If she files an I-130 now, then I will get a priority date of 2009. Is it possible for me to use my dad's I-130 petition's priority date on a new I-130 that my mom will file for me?

I understand this is pretty confusing, but if anyone knows or has any experience doing this in the past, then can you please let me know.

I will appreciate everyone's opinion.

Are you inside or outside the US? If inside, are you here legally? Are you under 21 years old? Under 18?

Your answers to the above affect the available strategies for you.

I don't understand another thing though.. If your dad filed for you in 2004 in WHICH category are you current?? Even 1st category is serving July 2003. If you are/were under 21 years old then PD is June 2005 (which means you should of apply LONG time ago).

And no if your mom will apply for you it won't make you any better from what I know (I assume you are over 21).
