Intent To Deny Aos

Hi everyone
A little background about the case: My husband and I has our interview for AOS (marriage based) at the end of March and that time we answered all the questions and everything seemed to be running smoothly;however our officer did notapproved or deny us. Two months later we still hadn't heard anything so we made an infopass appointment last week and at that time they said they would mail us something in 30 days.

Present day:Today we received an intent to deny our AOS because basically the birth certificate we submitted for my husband doesn’t have his name on it and they require one with a name on it....but the thing is in India where my husband was born when you are first born they don’t give out names for the baby and so they issue a birth certificate without a name...we explained this to our interviewing officer...at that time he said nothing. In the letter we received it stated that we need to either show secondary evidence or "affidavits from persons who are not parties to the petition"-what exactly does this phrase mean and if we fail to show this evidence our application will be denied. Now my quesiton to everyone is has anyone else experienced this and if so how did they go about doing this and if the affidavits we send or not to our liking will they definitely deny us.

What exactly is secondary evidence? It says to submit the evidence in 30 days but it doesn’t say to where....do they mean the district office where we had the interview. I would feel more comfortable if I could submit it to them in person like at an infopass appointment is that even possible?

Thank you

I agree with you about the BCs from India. They do not have names on them.

U shud get two Affidavits from parents in addition to the current BC. This will solve ur problem.

Yes I heard that...because the ritual/ceremony is like a month after and then is when the child is named...or sort of. But why the authorities do not give a new paper then with the name on it? and what about a non-availability certificate?

And you never received a RFE because of that?

Not all the officers on interviews can say what is missing or what needs to be done, everything goes to a supervisor and that person is the one who later on ratify if everything is okay or not.

Good luck,

Affidavit from the Municipal authority , school , parents may help also submit your voter card ID card (if you have one) which has your date of birth and class X marksheet.

Good Luck

May I ask Who is the beneficinary in your case, You or your husband?? The reason I'm asking this is b/c my Birth certificate doesn't has my name on it either. Although I'm a naturalized USC. I am worring now as my husband has his interview later this month. Could this be a possible problem at the time of his interview???
Thanks

As a USC, you only need to prove your citizenship status by showing either a US passport, or a birth certificate if born in the US, or the naturalization certificate. Dont worry and you will be fine.

I will suggest a letter of Affidavit from his parents, a letter from the local council where he was born.
I read somewhere that a letter from your Embassy can also be use

Pls act fast

Good luck

The instructions are clear.
Affidavits + a non availability certificate from concerned authorities to be provided in lieu of a non available birth certificate

As for the letter from the embassy, it is not guaranteed to be accepted, while it works for few, it gets rejected for others.

Hi thanks for all your response...anyone else been through this....also should I send them copies or the actual affidavits

thanks again :)
