INS Zero Tolerance Policy

According to the AILA, the INS has instituted "zero tolerance" policy and does not exercise discretion for those who fall out of status, unlike previous practice. Apparently, this hardline policy is instituted because of the ongoing pressure from the Administration, the Congress, and other political forces. This is a wake-up call to those who have relied on so-called "liberal views and interpretation" of the laws and regulations by some employers and their legal counsels. Please remember that all those liberal views are never blessed by the INS either in the form of policy memorandums or the required regulations. As people know, this is a very difficult time and the INS is under a tremendous political pressure within and without the agency.
