INS need my paystub which I don\'t have

I got laid off and my last paycheck is on 11/02. I filed a H1B transfer
on 01/02/02. Last week I got a letter from INS to ask for paystub from 11/02/01-01/01/02 or evidence to keep my valid status.
My attorney suggested me to give INS my w20 of last year and claim my situation to let them exercise the discretion.
Will it work?
Does anybody has such experience?
What\'s the possibility for INS to approve or reject the transfer?

I appreciate any help and suggestion.

same situation here .. I got RFE on my H1B transfer application

Do you mean your last-year W2 form ? I don\'t know if that will help.
May be your lawyer is right. In my case, the INS has issued an RFE,
asking more evidence of my legal status since I entered in the US
long ago. There is a almost 2-month gap after my last employer
closed the doors. Now, I wonder if:

1. What are the chances that the INS is going to reject my
   application after receiving reply on the RFE ?

2. Will a letter from my now-defunct company\'s then-HR-manager can
   help to strengthen my case ?

4. Can I convert my H1B transfer application to new H1B application,
   if the former one is pending on RFE ?

5. Does anyone know the exact date of the INS\'s statement on the
   status problem of H1B laid-off workers ? Can I say that the INS
   guidelines were not clear on legal status of H1B visa, after my
   company shut down ?

Any helpful reply will be greatly appreciated.
