INS mistake.....can I do revalidation?

My husband's 6 years on H1 technically expired on 30th Jan 2004 but he got the I-797 and visa stamp till 31 May 2004...

Last wk, he also received his 7th year H1 extension( I-797) which is valid till 29th jan 2005.

Now he wants to revalidate the visa ....Can he send his passport now or do we have to wait till May 2004 ?

Can anyone pls let me know ?

You can submit the passport for revalidation before 2months of expiry of your visa, so he can submit.
