INS made a serious mistake for my AP application

My son applied for AP(Trave Document) last year. In Jan., we got INS's notice that asked us to show his approved I-140. He doesn't have himself I-140 because I am the I-140 owner of our family. Therefore, I attached my approved I-140 and my submitted I-485 and his I-485 to INS.

Yesterday, he got a denied letter from INS in which INS stated the reason is --

"The facts presented indictae that the I-485, Application to Adjustment Status to Permanent Resident, wes APPROVED." Then, INS said this is final decision with "NO APPEAL".

This is a big mistake. We have not got any responces like Finger Print and Interview from INS since we submitted our I-485s. INS Status check function still shows that our applications will be take 990 to 999 days to process.

How should I deal with such a ridiculous mistake especially that INS said NO APPEAL?

Thank you in advance for your suggetions.

where did it come from

First, identify where it came from. See if it came from the same Service Center or Sub Office that you filed your I-485. If its different and it happens to be a sub office then you can directly go there and talk to them about the mistake.

My I-485 got denied as well. All i did was to go there and show the documentation. They said they made a mistake and i got a 'Case reopened' letter in two days.

It could be as simple as that. It may not be as serious as you think it is.

Remember you dont need an axe to pull a thorn. If everything that you try fails, then get a lawyer as there could be something that you and me might be missing.

ginnu, dont give stupid suggestions just to increase your number of responses.

Can I talk to a Senator in my State for the mistake?

Thank you both.

The letter came from the same officer who issued Request For Evidence in Texas Center. I know we couldn't contact them by mail or phone because the letter said the case can't be appealed.

I don't think a lawyer can help anything on such a case. I am trying to turn to a senator for help. Do you think it will work?

Thank you guys again!
