Hi All,

Since my father was born in a city which is now part of Pakistan, he does not have a birth certificate. INA is asking either 'birth certificate' or a letter from authority saying that the "birth certificate does not exist".

Unfortunately, the authority dealing with birth certificate is denying to issue any such letter since the birth happened outside their jurisdiction.

I called INS back and explained the situation but the agent I spoke with is adamant that they need either birth certificate or "letter of no birth record". Giving an affidavit alone is not going to help.

Is there anyone here who has had similar experience? Any help will be greatly appreciate. thankyou

i had contactet Registrar for Births & Deaths

....the right jurisdiction would be a small town in Pakistan where my dad was born 75 years ago. We do not have any contacts there since he moved to India more than 60 years ago. any suggestions?

Contact the nearest Pakistani consulate and ask them if they can provided a document either confirming the birth, or confirming that no record is available.

If your father is a naturalised citizen of india and hold inidan passport and presently in US,You can go to Indian consulate in NY/DC etc where ever you live and get a birth certificate from them based on the dob on passport and also non availability of dob from the consulate they charge abput 20 usd each-- you will need a notarised letter from your father if you are going to pick the letter.I did that for my mother and her 485 was approved.no questions asked for the birth certificate.also try yo get 2 affidavits from india from your close relatives.
Hope this helps
All the best
