Initiating an enquiry on I-140

I had my lawyer call the NSC folks in an attempt to initiate an enquiry. This is what I have learnt and just wanted to share it here.
  • Only your company (the one who applied your 140) or the lawyer can initiate an enquiry.
  • They (USCIS) will accept an enquiry request if and only if the processing date published on their site is 30 days ahead of your RD. e.g. USCIS states on their site that they are processing May 08 2003 for EB3. So, if your RD is on or before (roughly) April 08 2003, you can call them up and they will look into it.

I too had called the USCIS some time last week trying to initiate an inquiry and was mentioned the same thing what was mentioned to you, however in your case looks like your attorney called so he should have been entertained..

My Receipt date is April 8th and i might fit that "processing date published on their site is 30 days ahead of your RD" rule.

But i believe it would be a good idea to wait for a few more days and then initiate the enquiry.

What do you all think?
 
My EB3 case is pending since March 7, 2003. My employer has opened a case referral as well. I want to share few things with you which I learnt with my friendly banter with BCIS Agent.

If BCIS does not get back to you in 30 days you will have to open another case referral / query, their system will force them to open 3 queries before it suggest any escalation.


I also learnt that if INS does not respond to you in 30 days there is an EBIS number which your employer / lawyer should get after calling BCIS to find out more details about your case. I tried to get EBIS number out of them but they did not give it to me.

If you or your employer gets this EBIS number please post it here.

EB3 has been changed to May 08 2003 on the USCIS site. This was posted by them on Mar 04 2004.

Not a bad Idea. But, why wait? May be, you should have your lawyer or company call them as early as today (if possible). There is nothing wrong in doing that. At least, you will know what is happening with your application.
 
My I-140 - EB3 is pending since May 2002. (YES 2002)
My Attorney, already raised 3 enquires, last was in first week of Jan
Have not heard anything on my case.

Called USCIS this week, talked to Immigration Officer, and he suggested me to write a letter to USCIS about my case. He has no idea about this delay.
 
waiting4140 it is very sad about your case. It makes us feel even more uncertain. Did you try EBIS thing I suggested?
 
I am not sure about EBIS number; I need to ask my company.

Yes I did talk to the Officer, atlease that’s what call center agent told me before transferring the line.
