I am an asylee in USA,got approved on 2003, filed for adjustment 2004 and I just recently got a notice from INS to go for Intial Interview in local office,
the thing is on my mind that I just renew my national passport (NP).
alot of my friends are asylee also but they never asked to have an initial interview.
My questions are :
1. Will it be a big problem/ or effect my adjustment since I renew my NP?
2. Why do I have to go for interview?
3. What kind of questions that they will ask me?
4. How long is the interview? Do I need a lawyer to go with me?

so please,if anyone could help me I greatly appreciate it....
Thank you--

If you renewed you NP while you were still an asylee (which is your case) you may encounter some problems at the interview and the officer may think you are seeking protection from you country.

Why did u renew your NP WHILE YOU ARE STILL AN ASYLEE?

dont be afraid

its not a problem to renew your national passport, i renewed many times, i never got any problem,

the reasoned i renew my passport because some foreign countries dont recognize RTD,

i just came back from dubai and kuwait, both of them dont accept RTD,

if and if during the interview asked you bout this issue, tell them you renewed
your passport because you are planning to go to some foreign countries that dont accept RTD,

IF you have RTD, dont take your passport to the interview, just take your RTD,

THE interview is very simple, my wife who is deivative asylee did it, it lasted
10 minutes, the officer asked her few simple questions,

where does she works, what does she do, has she ever outside the USA more than one month,

he stamped her national passport with approval and told her she will get the card by mail within 2 weeks,

you will get approved during the interview, most of the times the officers dont ask anything, they really dont care

This can be a serious issue.

What sort of issue Thankful? One of the fellow countryman that I know recently renewed his passport and he's still an asylee and hasn't even applied for permanent residency because it hasn't been over an year.

Use common sense.

It is either an indication of fraud and/or that conditions have changed so that you no longer need protection of this country. The law says that asylum can be removed if conditions change. The law also says that if you renew your passport while on asylum status it is evidence that you no longer need protection.

Does it really? So what's gonna happen to that guy then? He's already renewed his passport ( foolishly it appears ) and he's excitedly looking forward to applying for PR! Also, how will the U.S. govt. know that the passport has been renewed?

The question is if they will find out about this. If they do they will look at it seriously. At a minimum it means a lengthy review of the asylum case (I know for a fact this is the procedure in New York City). Any asylum attorney with minimum competence advises asylees not to renew.

thanks for the info

Thank you guys for the info and respond...
this forum is really help me.
I renew my NP because I was so worry that my GC application has been denied as you guys know I applied GC in '04 and just got this notice in feb '08 for interview.
and also I asked my lawyer about renewing NP, and he said it's okay to renew, you will need your NP to travel anyway. Since he knows all about the law so I trust in him.

thanks for responding me....
questions for you..
1. Do I need to hire lawyer to accompany me during this interview?
2. I have RTD that expired Dec '07, should I bring that or my NP(new and old)?
3. when I do my medical exam I showed them my new NP, so you think I better give them my new NP?
4. Did your wife renew her NP also when she went for interview?
5. if they dont approve my GC do they take me to jail right away and deport me?

please help me again........
thank you so much for the help
I appreciate that..

You worried about a green card denial and in response you renewed the passport? I do not undertand the reasoning.

yes, I got a notice long time ago-not sure probably a year and a half ago-- that my GC application has been denied/rejected, but when I check my case online the case is still pending in TX service center.
I asked my lawyer and he said that it might be a wrong notice that INS sent me, I called many times to INS and they said your case still pending--they dont know what went wrong either--
so I totally confused/worried and everything!!!
thats why I renew my NP since I have no clue where I am going to stand-- US or my homecountry(where I dont want to come back)
so I am still afraid to be in the interview end of this month!

dear crusher4me:

you dont need a lawyer for this interview, its very simple interview with few questions, you are almost approved right now

when you go to the interview take every thing with you, all travel documents,
show them your new NP,

dont worry , i dont think they will ask you anything about your NP,

IF THEY EVER asked you about NP, just tell them the truth, you renewed it because you thought your asylum was not going to be approved,

i just remember something important to share it with you:

in 1997 my asylum application was referred to the immigration judge, during the hearing the i submitted my renewed NP, THE government asked me
why i renewed my NP if iam seeking asylum,

my answer was, i am not sure if i was going to be approved for asylum,
and i need a valid identification document,

the government was convinced of my answer, and i got asylum approved by the judge,

again, its not a problem if you renewed your NP,

MY WIFE WENT TO THE INTERVIEW with a valid NP,

THE INTERVIEW officer dont have the power to deny your GC application,

good luck to you,
iam sure you will be fine

It really depends on the officer dealing with your case. When i went for my asylum interview, she asked where did i renew my NP and i told her in NY , she collected it from me and went out of the office and gave it back to me. I dont know what she went to do with it, it looks like she made copies or made phone call or something but I got approved the next day and i picked up my approval letter in 2 weeks. It really depends on your case and the officer involved.

Thank you so much for sharing all the info
I am abit okay now :)
btw, did u ever go for intial interview too?
Do u get your GC thru initial interview?
because it's kinda strange for my case because all my friends (asylee also) don't have to go for interview to get their GC. and they don't get stamp in any passport. They got their GC after doing all the requirement like medical exam and fingerprint.
Do u have any stamp in your NP state that you are approved GC?
Thanks again...

Did the officer ask her about the story about the asylum case again ( I mean questions why you apply for asylum)?
or it's just anything about GC questions?
because it's been 6yrs since I got my asylum interview, I am not really remember the whole thing that I have told to the officer.

thank you friend for the help

Correct me if Im not correct, but I think you said in previous threads that your wife is a derivative asylee from you. In which case the renewal of her passport may be indifferent to the officer interviewing her.

In the case of Crusher4me, he/she is the principal.
