Information regarding PCC

Ex CP'ers and other friends,

I am trying to obtain PCC's for self and my family. My daughter is 4 years old. Would she also need a PCC for CP?.

Has anyone come across this kind of situation?. Please help.

All of us live in the US for the past 5 years. Does that make any difference?

I just wanted to know if you would need local PCCs from India. Since you all live in the US since five years, only the PCCs from Indian consulate nearest to your location would be sufficient.

SA suggested by jigesh and alren, contact the indian consulate which caters to your state in usa and expect to get the pcc in 6 weeks from the date your applied.

Thanks everyone for your inputs. I was going through the website for the US Consulate in Chennai and it has been mentioned clearly that only people 16 years or older requires PCC. I am also going to send an e-mail to the Chennai Consulate to verify the same.

Now, along the same lines regarding the validity of the PCC I know that the PCC is valid only for 6 months. Is the 6 month period counted from when the request was made (or) is it counted from when the PCC was issued by the Consulate?

I am asking this only because if it is based on the first scenario then I can apply for the same in the end of April, else if it is based on the second scenario I could apply now.

BTW, my fee bill was issued by NVC and I have sent the fee to St.Louis facility on 04/03/2004.

Yes pcc is required for folks 16 years or older. And the 6 month pcc validity starts from the date when the pcc is issued by the consulate/ date pcc stamp is put in your passport (not from your date of application for pcc).

Since you have paid your fee bill, it may be a good idea to apply for pcc now IF your attorney needs to see the pcc before you mail your packet 3 to nvc or if your attorney does not want to see the pcc before packet 3 mailing to nvc, then you can apply for pcc at the time of mailing packet 3 to nvc.
 
In general this is not so much of a scrupulous process as the US immigration. There is no way of knowing (for the US conulate), when the application was made. The final deliverable you will get is a issueance dated certificate and the same dated stamp on the PP.

So don't bother much.
 
Follow-up regarding PCC

Thanks for all the friends who have replied to my query regarding PCC for my daughter (5 years old).

I also sent an e-mail to the Immigrant section of the Chennai Consulate and this is what they replied.

Though to share this information in this forum as it may be beneficial for others who are in the same situation as me.

Another question to friends and ex-CP'ers.

I have also obtained the Canadian PR and the PR visa is stamped in my Passport. I am yet to land in Canada as a Canadian PR (Planning to do this in May, 2004). As per the dates my CP interview may be scheduled in July or August of 2004.

Would the Canadian PR cause any problem during the CP process?.

Have anybody been in this situation?.

What are the questions that I could expect from the officer who interviews me?

Any suggestions from Raju, KD, Jiggesh and other seniors are welcome and highly appreciated.

Answer: I personally do not think this would be an issue but just be ready to answer some questions.

Answer: Both canadian and usa residency have a physical presence clause. So be ready to answer questions around why you need usa residency when you have canadian residency and if you get usa residency, you may eventually end up losing canadian residency or vice-versa. So i would assume you get asked question such as above. But remember having canadian residency is NOT a reason for not giving usa residency so definitely do not be stressed about that. Just be confident when answering questions.

The Canadian PR will not cause any problems in the green card process, but if they know that you have a Canadian PR, you will be asked to surrender it when you go for the landing for the first time on the US immigrant visa. In my case, I am a Canadian PR who has just got the green card. The INS agent informed me that I needed to give up my Canadian PR, but I would be given reasonable time to do this and move to the US. However if I continue to hold on to the Canadian PR, then the INS could revoke my green card. He told me that he had put a note to this effect in the system against my A number. When I asked him what he meant by reasonable time, he said "a few months". To be on the safe side, I am going to surrender my Canadian PR in 3 months, after moving permanently in the US.

This is in spite of the fact that I have completed 730 days in less than 5 years in Canada and met the requirements for retaining the Canadian PR. I called the Canadian Immigration about this. They said that as long as I met this condition, I can retain the Canadian PR and get a new PR card after 5 years. But if after the next 5 years, I do not meet the requirement of 730 days, I will have to give up the Canadian PR.

The INS does not seem to care about this. They insist that you must give up your Canadian PR when you get your US green card.

Incidentally, my daughter is Canadian as she was born in Canada. She can sponsor me back as a Canadian PR when she is 18 years old, but that is too far out in the future.

It is normal to be cautiously optimistic and i dont think you are paranoid. It is normal especially since you have a special situation which relatively fewer folks may have.

PCC stamping

Hello seniors,
I am just thinking, so please bear with my question

My wife and kid are leaving to India next week and planning to stay for a month or so. I am dreaming that if my I-140 gets cleared in meanwhile then I am planning to ask my family to continue to stay in India till the CP is done.
If I apply for PCC then assuming after six weeks I need to send my passport for stamping then how to get my wife's passport stamped ? Is it adviseable to get her passport through fedex and get it stamped and carry with me when I go for CP ?

Any advise is appreciable.

I should say you are really thinking thru the process which is very evident from your question. This is good.

It is not recommended (in fact illegal) to courier the passport from india to usa while the passport holder is in india or vice-versa. Plus Indian consulate will not issue PCC while the passport holder is not in usa.

Even if your I-140 gets approved by end of April, you are still looking at least 6 months to get cp interview. So are you thinking of having them stay in india until you get the cp interview (about 7 months). If that is the case then your spouse can apply for pcc in india (1 from local commisioner office and 1 from regional passport office)

Q The fee for PCC at SFO is $20 and Overnight mailing is $15 which I can club togeather and send it but my question is can I include my wifes passport copies along with it and make one money order of $20 (myself) + $20 (wife) + $15 (mailing charges) in one money order ? or do I need to seperate both of them and send two instead of one ?

Any advise.

You should be able to club together your pcc money ($20) + your wife's pcc money ($20) + single return mailing fee ($15). This is what i did but at CG New York. MAke sure to put a note on that chasier check that this is for PCC's for you and your wife and mailing (put names as per passport). $15 mailing is more than sufficient for mailing 2 passports back!
