Hello,

Two weeks ago my visa transfer/extension got denied and because of that I have been in Out of Status for sometime and left to India. Now I got new H1B petition approved through employer 'x' and want to work for him. Do I need to have a new visa stamp on my passport to enter into US or enter on my ex employer's visa, which is valid until end of next year (2006) and show new petition at POE. Does the second approach could have any risk?

Please let me know which is reliable way?

Thanks,
SAK

-------- if you got NEW H1 petition approved(I dont think it has I-94 attached with it) then get New H1 visa stamp and enter

Yes, you are correct. USCIS has not issued me I-94 as it was a new H1B visa.

Again I want to repeat that, I have a H1-B Visa on my passport and it is valid until OCT 2006 (this visa was from my previous employer)? Can I use that to enter into US and obtain a new I-94 by showing the new approval petition?

Or I have to go for stamping to get an new visa?

Please elaborate your answer.

Thanks,

SAK
