Info-less pass!

hi folks - just back from a scenic drive - 50 miles up and 50 miles back for an info-pass to find out why my I-140 (EA) is still pending 4 months beyond processing date and 45 days past first service request. USCIS did not disappoint - the IO looked into her monitor (dont know whether she was reading CNN or really looking up my case) and said the following: Yes, no officer has looked at your case yet, but someone is assigned to look at it (this info she got from the documents I gave her). There's nothing much local office can do regarding I-140 and I need to call on the 1-800 number. So, I came back - hell with the National customer service and instead tried the POJ method. Surprisingly I got through to NSC but ended up on phone queue - waited one hour on the phone and said enough for the day. Hopefully tomorrow will be a better day. We can only hope.
 
This is nerve racking...! Just keep patient... Sooner or later, you will hear the good news hopefully.

Did you ask about your EB2-NIW?

Is it worth going to a local office for I-140? The last thing I heard from USCIS is that my case was looked at on Sept 27 and I should get some update in 60 days. I am thinking that on sept 27 my case must have been assigned to an IO and that they have a policy to make some decision within 60 days. Do you gusy think thats likely?

Although my personal experience says otherwise, I think it is worth giving it a shot. A lot depends on the person who talks to you on that day. Unfortunately, the IO i got for my infopass was a lazy idiot with a negative attitude. A more positive person might atleast attempt to make an effort. I say, if u have the time and energy, give it a shot. Not much may come of it, but u will have the satisfaction of having tried.

i just talked to my attorney and he had the following to say:

the last option is trying to get a congresman or senator's office to follow-up but the problem apparently was they did this to a couple of guys recently and ended up getting prompt responses but unfortunately the response was a comprehensive RFE. So, he suggested - best is to wait, but if u must contact congressman's office, - try this. Dont just send your recipt number, but send a supporting letter from some bigshot saying why your work is being affected - sort of like a recommendation...and ask the congresmann's office to sort of help you push the case, rather than just ask for status.
 
Thanks madmonkey. Yeah I think I am going to wait for some more time before contacting my congressman. My attorney found out that they last looked at the case on sept 27th and should update within 60 days. So I'll definitely wait till nov 27rh and then decide on the next step.
