Just got a verbal briefing from my attorney's office:

Overall tone is quite positive but still no comittment: they are running at least on schedule (which means they probably running ahead the schedule at this time.) However, they don't intend to update the chart at this time or in the near future.

First-in first out: they will approve the case according to ND in a reasonable way. "Various factors caused delay of some cases" This is a typical BS from them. According to my attorney's office, they do appear to approve cases based on region, which, you can't argue with them, since they can fight back by saying it is risk-based or they want to give every region a fair share.

Real ID Act impact: asylee adjustment is one of the priorities of reducing backlog, for now.

other stuff is not relevant for me... I did not bother to let her tell me.

Right. But they don't tell you which methodology they use, though. Again, the whole thing is BS, except that I know they are probably ahead of schedule.

Answer: "There seems to be no problem, at least from what we have seen so far."


Ask: "It looks like some mails are definitely lost, but others, like intent-to-denial" letter arrives well on time."

Answer: "We are very organized and current on our mailing list. Please check USPS for mail loss."


Ask: "Ok, if the applicant did not receive the mail, how much time after you will mail out a reminder or even an intent-to-denial letter."

Answer: "It is the applicant responsibility to keep their cases updated by calling 1-800, making appointment to local office, etc. Our processing won't resume unless we receive the information we requested for."


This is just typical BS!

Hi Wind,

Don't scare me about the "Intent-to-denial" letter. I thought 99% of the cases should get approval soon or later. As I know, as long as you don't have any criminal record or any violation, you should get approval if all the documents requested by NSC has been completely received. Do you know anyone received that letter?

You are right. The intent-to-denial letter is sent to those who don't respond to their RFI. (Huh, 99.99999% is because INS' mailing problem.) Then, they do allow you to appeal. Appeal takes up to 9 months now, and then it is going on and on and on.

According to them, if you don't take FP, they just stop processing your case.

William, it is for only those poor guys who don't keep their cases up-to-date. Not you and me.

You said that you might get denial if you don't take FP or stop keeping your case up-to-date. What if people jump ahead of doing BIO, will they get approved in advance?

That's a good question. I don't know if you do bio in advance. But they won't let you do it unless you have appointment. So we are talking about doing it days before it is scheduled. I think bottom line is, it is probably not a bad idea to have it done in advance.

Now, I don't think you can go to local office to do bio, if you are NOT entitled to do it.

I would rather stay on the schdule instead of making fake story trying to persuade the officer there to let you do it in advance.

There is no story to tell. They give you an appointment, you can change that appointment..it says on the form they send you. Its not getting ahead of anyone.its just suiting your schedule..Its not as complicated as you are making it sound.

I am very conservative on certain point of view. I won't take a risk to jeopardise what I have been waited for 4 years.
