Stuck in a Paradox!
A relative of mine is now in removal proceedings as he was out of status.
He applied for asylum possibly 12 years ago.
Asylum was denied
Other applications like labor certification was also denied over the years.
He is now in detention.
He does not have his indian passport anymore and it has expired.
Question -
If he had previously applied for aylum, and it was denied, but in the application of a new Indian passport - there is a clause "Applied for asylum".
Can he sign on this passport application since he had once applied for an asylum (even thought its denied)
We called the indian embassy hoping to clarify - they were impolite and said we should know how to read english.
Can anyone advise what will happen to him- Will the Indian embassy eventually give him a passport if he signs on the form, ignoring that statement?
Can he legally sign on the form - even though he applied at one time?
What can the detention center do to him if he doesn't sign the form?- will they prosecute him further?
