Indian passport for Asylee who was denied?

Stuck in a Paradox!

A relative of mine is now in removal proceedings as he was out of status.

He applied for asylum possibly 12 years ago.
Asylum was denied
Other applications like labor certification was also denied over the years.

He is now in detention.
He does not have his indian passport anymore and it has expired.


Question -

If he had previously applied for aylum, and it was denied, but in the application of a new Indian passport - there is a clause "Applied for asylum".

Can he sign on this passport application since he had once applied for an asylum (even thought its denied)

We called the indian embassy hoping to clarify - they were impolite and said we should know how to read english. :(


Can anyone advise what will happen to him- Will the Indian embassy eventually give him a passport if he signs on the form, ignoring that statement?

Can he legally sign on the form - even though he applied at one time?

What can the detention center do to him if he doesn't sign the form?- will they prosecute him further?
 
He should not admit to having applied for asylum, especially since he was denied it. He should write a letter saying he's out of status and get it notarized and include it with the $40 application fee and the filled passport renewal application form and send it in.
 
I think Indian Embassy is only denying for new passport if your asylum is approved. I had renewed my passport when my case was in processing (I saw them my work permite copy which had code). Again I went for new passport, that time my asylum was approved (I saw them work permite which had code - asylee) and they refused to give me new passport.

I don't think they will find out that your relative had applied for asylum unless he tells them.
