India Trip without AP. Urgent pl.

Advance Parole

Aliens applying for advance parole on the basis of a pending application for adjustment of status must be approved for advance parole prior to leaving the United States in order to avoid the termination of their pending application for adjustment. Note: this does not apply to aliens who have applied to adjust to permanent resident status and who maintain H-1B (Specialty Worker) or L-1 (Intracompany Transferee) status, or their dependents, who have applied to adjust to permanent resident status and who have valid H-1B or L status and valid visas, V nonimmigrants who have a valid V nonimmigrant visa, are in valid V nonimmigrant status and have or obtain a valid V nonimmigrant visa before applying for readmission to the US, and K-3/4 nonimmigrants who have applied to adjust to permanent resident status and who have a valid K-3/4 nonimmigrant visa, are in valid K-3/4 nonimmigrant status and have or obtain a valid K-3/4 nonimmigrant visa before applying for readmission to the US. Now comes the part II of it. She flew on 15th and 485 (Jan 2003 filing) is approved on 17th. She is returning back on 26th on H4. I will update the forum to let others know what is happening at POE. Hope it doesn't trouble her....
 
I have the same problem.
My wife left on 17th and we both got approved on 18th. But she has valid AP.
I'm planning to stamp and leave and we will come back in Jan.

2 years ago after marriage, she got her H4 VISA the day after I left India and we couldn't come together. Now, She left US and her approval came day after.

She'll have no problem but a deferred inspection.
 
She came back without any problem. No questions asked. Now I have taken infopass appt for both on 10th. I will further update on that after I am done with that. Thanks guys.

See a valid VISA always helps and there is no reason to be deported if you have one ( and have no criminal record ) :)
 
My wife came back via newark yesterday. No questions asked except the officer asked for her SSN and said 'enjoy with ur green card'.
I guess he looked at her status and found that it was approved. So travelling on AP after 485 approved is not a problem.

All,
I and my wife got our 485 approvals while we are out of the country (trip to INDIA). We plant to re-enter the US using our AP via Newark on 01/16/05.
Does any one know if there are different lines for H-1 visa versus people with green cards?

If yes, which line should we enter? What questions will we be asked potentially?

please help.
