To all the H1Bs from India who are working in the US I have a question. Do anyone of you know if you are supposed to file an IT return in India if you are working in the US (it could be NIL return)? If anybody has any accurate knowledge on this issue please let us know. Is there anything in the tax law in India that the H1Bs need to know about? Any accurate input will be appreciated.

If you staying in abroad for 6 months or more, then you are considered as NRI. I think you need not submit IT returns in India.

krishnagc is correct!

If one stays beyond 180 days in a calendar year out of India, one is considered an NRI and does not need to file a tax return for that calendar year. It's been 3+ yrs in the US for me and I haven't filed any tax returns in India for those years.

Btw I did 'see' the 180 day requirement on the Indian tax forms.

Hope this helps.
