Including Spouse on 485

Hi Guru's,

I am filing my concurrent 140/485 in EB2 category. My wife's employer will also start her immigration process (she doesnt require a labor and works for the department of State as a contractor) in the next few months.

My question is; if I include her in my petition, will her case be dependent on my case getting approved? (I ask this as I am a male from Pakistan and I KNOW that I will get stuck in a name check for sometime. She on the other hand will not and I was wondering if because of that she can get an earlier approval of the GC being my dependent on that petition and can get on with her life?

Any ideas?

Name check done not just on your name. It is done on all names of the Family members Even if they apply separate. It is very elaborate process includes your parents also.

In understand THAT..But if she clears her name check before mine, will she be given approval OR will she have to wait for my name check to get completed in order to get her GC?

I guess what it means is , To clear her name cleared they will check your name also. It will be struck at both the places any way
 
Do you mean the principal case will not be approved if he already got everything cleared but his spouse is still stuck in the NC? Where did you learn that?
 
I think he means the other way around. i;e if a spouse gets cleared and the principal doesnt, then they both remain stuck until the principal gets cleared. Correct me if I am wrong.

No. What I meant is your name check includes your wife's name check even though she is not a beneficiary. This is true even if spouse has not applied for the Green card.

Not correct. I know many cases when one spouse (principal applicant) got green card, and other (derivative) was waiting up to several years longer because of the name check.
So sure it is better if each spouse has own application and is principal applicant....

Well. USCIS/FBI go with Biographic information provided from each person. Whenever they do name check they will do the name check for each person independently including his/her parents and spouse based upon Form G-325.
