Friends,

When I acquired EAD last year, I registered LLC (Limited Liability Company). In month of november(8 months after EAD) I decided to convert back to h1 so went out of country and came back on h1. Until now LLC is dormant, no income.

While I file company (LLC) tax return of year 2005, would that be a problem for my h1 status? I am confused due to my EAD, h1 status. On h1 status I know I can't register my company.

Since there was no income for year 2005, while filing return (for LLC) I am going to mention same (no income, no expense. it was in dormant stage).

If I show revenue = expenses = no profit. would that be same as above and would be considered same as above?

I think in first scenario it will be considered as dormant/inactive but second scenario would be different ??? Please advise what's the best way to not affect my h1 status and avoid issues while I-485.

Thanks,

You can register an LLC on H1; you just cannot do any work for it. If there's no income and no work being done for the company, you should be fine.

Thanks for quick response.

What if I show $x amount of revenue and also $x amont of expense = no profit? would that create any prob for my h1 status and future I-485?

If you were doing work for the company, then certainly. USCIS doesn't care wether your company makes money or not, they care if YOU WORK for it. If you create a company and it makes $1,000,000 in profits that don't involve you working for it, that's just fine.

Me and my wife(she also converted back to h4 when I converted to h1) were the only members of the company. can you advise what's the best way to deal with it?

Most likely I will file return for company as no activity, no income. however if my h1 status and future I-485 don't hurt by showing some revenue and same amount of expense = no profit, then I may think of that avenue. I highly appreciate your help. what would be wise to do?
