in dilemma

MY old EAD is Exp on 8/23/03
And i filed for renewal on 5/29/03
So. technically 90 days would be done on 8/27/03.
So for those 4 days would my status be illegal.
I do not have H1 and I'm working on EAD card.
So what should I do??
According to processing time my case has already been worked and now they are working on case from 06/02/03.But on the website it still does not shows as any RFe on my case or it is approved>!!

So what can be worst case??

I have never left my employer, and working with him but they has situtiaon that as soon as my ead comes they would cancelled my H1.

First thing first .. Next time .. Use calculator or some sql
function to calcuate the days !!! Keep buffer of atleast
10 days for mailing .. bcis receiving etc.

1) take leave of absence for those 4 days.
2) work for 4 days but ask your employer to adjust salary
some other ways .. (like pay you for over time next
pay period ).
3) say nothing .. do nothing .. take it as it comes .. bcis
may not notice the gap (this is risky option !!)

I think, you should be fine. Here is what I understand about 485/EAD/AP process

1. Your status is legal and valid, as soon as you file your 485 application

2. EAD is just a work permit to work. It has got nothing to do your legal status. However without a EAD, you are not allowed to (or supposed to) work.

3. Advance parole is a travel document that can be used to enter into united states.

These three things have three distinct roles to play.

In my opinion... take a small vacation for four days and go to Hawaii :)

PS: On a lighter side, I liked the idea of bhavoo. Use "select 'exp_date'-100 from dual; " to get the date on which you should apply for your EAD

option (2) is ok, (1) is better. (3) is a no no (risky, so you choose).

Another option is to try for iEAD on the date of expiry of your EAD. If you get it go on earning; if you dont take rest for 4 days and try again.
 
No panic. I have been through this.

I end up taking a 10 week leave of absence, no pay. 4 days is nothing.

Hi think i Would take leave for those 4 days and then would go to Iead. Would talk to my company HR regarding this.
