EB Category matters for mailing the application, i.e. the INS will receive your application only if your PD based on EB is valid as off the receipt date. Once received, the INS does not bother with the EB2 / EB3 except for when they come to final adjuducation. At this point, if your PD (once again based on EB) is backed up, they will keep your application aside till your PD becomes valid and then process your application.

(I\'m not a lawyer. This is just my inference from various posts I have read on this and other message boards.)

No it doesnt matter as long as both are current.

EB2 will be helpful only when the PD retrogates, since EB3 will retrogate more when compared to EB2.
