important question please give your opinion

Hi,

I have been in US for 10yrs and till waiting for GC. Due to retrogression (I am from ---- you guessed it right India !!!!) I am not sure when my 485 will get approved. I recently came back from India and I am thinking of returning to India. Things are really good in terms of jobs, money etc in India and I dont think it make any sense to keep on wating for ever and wasting the best part of my life for this stupid GC.

My question is

1. If I go back to India now before I-485 gets approved can there be any problem in coming to USA later on in H-1b , L1 or short term buisness visa. I guess since I applied for GC if I applied for student F-1 visa anytime in the future it will get denied.

2. If I go back to India after I-485 gets approved and I get GC(I will have to give up my GC in that case) can ther be any problem in coming to USA later on in H-1b , L1 or short term buisness visa.

I plan to take up a job in India and travel to USA, Europe etc on short term/medium term projects. In that way I will get best of both the world. Hopefully over the next 10-15 years India would be developing to such an extent that there wont be much difference between India and US in terms of career, jobs etc and it would make much better sense to be in India closer to family, Indian culture and values.

Then why the heck are u concerned about getting a stupid visa to the US? Stupid visa to US is more important than family, Indian culture and values? Or stupid family, Indian culture and values are less important than the almighty US visa?

I think one needs one of those "stupid" visas to enter the U.S. even for the short business trips he plans to make :)

Overall, I think he raises a valid point. My novice understanding is that short term visa such as B2 require one not to have shown immigration intent. An I-485 application shows one had immigration intent. So there is potential for problems later. Of course one could argue one abandoned that intent and in this way convince the consular officer.

Lawyers and gurus, please correct me if my understanding is wrong....

DO NOT TALK ABOUT 10-15 YEARS as DO NOT HAVE ability to make plans and act accordingly.
First make plans, sacrifice, wait, then reap. First decide what do you want to do? and be consistenet what you want to do.
Answer you seeking for is in your question, read, read, read, you will find it. Go and read posts here people have been living in this country last 18 years or more and still are in the lengthy process of GC and full of energy. You are weak in your decision and plans.

Not exactly...he is also worried about stupid F1 visa. Even for B2 visa...why does he need to be concerned? It is the headache of the company.
 
First, I do not want to start a flame war here. So please do not take my comments as incendiary.
Second, I do not want to be an apologist for the original poster's questions.

Having said that, here's why I think it is a valid question, even for F1.

Suppose you go back to India now, and sell yourself as the guy with U.S. experience, who knows how business is done in the U.S. and so want to become the U.S.-India liaison guy. Needless to say, you are valuable only as long as you are able to deliver on your USP. Your abilities and skills are fairly restricted if you are disallowed to enter the US because of one of those "stupid" visas. So don't you think the company which presumably pays top dollar, I mean Rupees, for your unique skill set feels shortchanged ? Getting you a visa is their problem but after a few failures on their part, it suddenly becomes your BIG problem. And if you decide on a career where you start a company, it is ENTIRELY your problem.

Now for the F1 question. A U.S. education is undeniably an ENORMOUS boost to a resume - and arguably adds more value than comparable degrees elsewhere. Say 4 years after happy Indian work experience, our friend decides to get an MBA, or a PhD, all to improve his value and earning potential and return back to India (afterall doesn't he want to grow his roots there?). His F-1 is denied due to his abandoned I-485. Isn't it important to consider than angle right now before making a leap where it may become impossible to return?

Finally, some people struggled for 18 years and maybe are still waiting. So what? Our ancestors lived without electricity, so do we give up on electricity? What's wrong is expecting the best, and if one doesn't get the best, plan for backup options?

I certainly do not want to wait 18 years (at least I think so ;-) and if it really starts looking like 18 years is it not reasonable that I think of other options?

Very simple, give up or decide.
Those who are still waiting after 18 years are NOT STUPID, they are consistent and goind on their decision they made. Regarding options, a strong decision is required, that he is laking of. He is not still sure what to do.
It is better to be in one boat to get to the destination. The permenent residency or visitor is not an option but a STATUS, which he has to choose from.

I have already decided to return. I never intended to settle here permanently.

I am doing parttime MBA from a IVY league school and will be done by mid 2008. This stupid GC is severly restricting my career growth. I am more interested in career growth than just staying back in USA.

I am looking for a senior level managerial role where I will have to travel quite a bit definitely to US. So getting visa is a must to make sure that my growth prospects are not hampered.

I would like to do a PhD in finance at some point(although not sure about it). This is the reason why I am bothered about F1.

As I have said I did talk to a few recruiting consultants when I was in India this time and from what I gathered in terms of oppurtunities and career gorwth this is probably the best time to return to India. USA is saturated and for growth India looks the best option. This is what I have concluded.

Go get the position as soon as possible.
 
How does "strong" decision help solve the problem? And why is a decision to go back now and may be come back for short business trips and/or a graduate degree (with the intention of going back after the degree) inconsistent with the original decision of going back?

You say the permanent residency or visitor is a "status" which he has to choose from. What does that mean? The problem that he asked about is if he chooses to not become a permanent resident will he have problems in being a visitor at some later point in time. So in other words, if he chooses the visitor "status," will USCIS respect his choice, or simply deny a visa? I still think that is a valid question to be answered. If anyone knows about this potential problem, it would be helpful for the community to know.

My 2 cents

I understand your dilemma.

Remember the growth in India (or for that matter China) is very much due to exports to US/EUR (services to US/EUR businesses). These economies are dependent on US econony. Until countries like India start developing their own creative products like (MSFT, Intel, Coca Cola, Military tech..) .. the economy is based on US.

Other point is that the salaries in India have gone up to a point that the jobs may move again to some other low cost country.

Higher paying jobs in India will come with lot of hard work, long hours and politics.

Opening a business in India trumps all, but is that for you?

It is your decision, but my plan is to go after the citizenship so that i can pick best option without loosing options. If it takes long time then this option may not be mine but i'll play safe.

These are just some comments out so many arguments.

Endless_wait,

When I applied for my GC I have also thought in same way. American citizenship is great as it means you dont need visa to travel in most parts of world.

As for India's growth all I can say is next 20-30 years we will see rapid advancement and lot of growth. Indian economy has a strength of its own (I am in international economics/finance so I get to see these data all the time) and nothing can stop the Indian growth story now.

Very soon China will overtake USA. India and China offers huge oppurtunities for smart people.

For me I really dont want to waste 8-10 more years here because that will be too late. The US economy from here will be stagnant so not much use to get stuck here. Also remember all the good people of the world are here and competition is so much more.

Anyway these are my personal thoughts. I came to US 10 years back. Got my MS and (will be getting) MBA from top 5 school, have got very good experience. Now I will go back to India and try to reach a top spot in a company. Lets see how things go.
