Hi Gurus,
I would first like to thank you for taking time to read my message.
Anyways, I have a small clarification on my H1-B 7th year extension.
When my last H1-B renewal was done, INS had certified it till Oct'2008, when my six years completion date was only till Apr'2007. So, my attorney had advised me that irrespective of whatever date INS had certified, we should still calculate the six years duration and renew the 7th year extension with Apr'2007 in mind.
So, we were actually going to file for my extension now and my attorney said that he is going to file an amendment to my H1 instead of my 7th year extension saying that since my expiry date is only Oct'2008 and since we are filing now; they would post a RFI saying that it cannot be done now. So, he wants to do an amendment to my existing H1-B rather than a 7th year extension.
My question here is if this is going to a problem during my stamping or for my greencard or so.
Please let me know, if you have any details or information on cases similar to this.
Thanks !
