Important EAD issu...Please help ?

Folks,

My wife\'s EAD is expiring on 3/12/01, and her renewal application receipt date is 02/01/01, I don;t think within 1 and half month VSC is going to renew her EAD. Does she have to stop her work ? What do you mean by stopping the work ? Does she has to take leave of absence/vaction ? Can we get temp card ? Please help. Thanks.

Yes, I believe she has to stop working, which means she can not get paid through her employer. Unless she has her own valid H1B. I was facing a similar situation before, consulted several places. Luckily, INS approved my renewal on time. After 90 days of her filing, she can go to local INS to get an temp EAD to work if INS hasn\'t approved by then.

I don\'t think that she needs to stop working because, I am in the same boat and my company said there is no problem if you do not get your approval. Problem might be only if your application is denied.

I want her to work legally, thats why I asked whether she can get an interim EAD card before 90 days. Problem is, with economy down, if she stays home for 2-3 months...she may get fired.

You don\'t need to worry. Normally VSC renew the EAD card from the ending date of expired EAD card. So she don\'t need to leave work or taking a vacation. If you really want EAD immediately. You can go to the local INS office and tell them the situation. They will issue her EAD probably the same day.

One of my friend has the same problem. He went to the local office and got the EAD in one day. I applied for my EAD 4 months before expiray.I got approval in two months and my new EAD has the starting date from the ending date of first one.

I was in the same boat. However the good news is VSC renews the EAD card fast. I appied for renewal on 12/12/00 and my application was approved on 12/23/00 . However I got the patic card only around 2/5/01. AVM was updated only around 01/25.

Please Talk to an IIO. When you apply for renewal of an EAD, INS finds out wheather it\'s being in use and also when the old EAD is
expiring. If the old EAD is expiring early INS ensures you get a
new EAD before the old EAD expires. This happened in my Friend\'s case when he applied with only one month to go on his old EAD.

Before making sure your wife\'s new EAD is approved, she can not work to take the risk as out of status. Though if INS renews her EAD starting from the day last one expires, it would be OKay for her to work.

As for going before the 90 days, it\'s not in the book. I would assume that depends on the office\'s mood that day. If you explained to them, they might let you get one, who knows. Just like going for FP before scheduled date, some got, some did not.

I applied renewal on 12/15, though it\'s only 2 days after you, but the approval date is 2/7. As for the new EAD\'s starting date, if the approval date is before the old EAD\'s expiration date, INS will renew starting right after it. However, if the approval date is after the old EAD\'s expiration date, INS usually will renew it starting from the approval date. If you follow the board long enough, there are quire a few such cases. So my suggestion is, don\'t take the risk assuming they will renew it right after the old expiration date.
