Importance of I-94 in EAD??

Hi All,

Has anyone in the situation where your H1-B visa is expired and so is your I-94 while stying in US. BUT you have your 485 pending and have an approved EAD and you are working based on that EAD.

I want to know, really wish, that does I-94 expiring matter at all when you are working on EAD.

Also when you switch to EAD from H1b how does INS is informed about your change??


Any help is deeply appreciated guys.

---- Many have I-94 expired after filing I-485, once you file I-485 you status is AOS pending and your stay is legal in US
I want to know, really wish, that does I-94 expiring matter at all when you are working on EAD.
--- no problem with expired I-94, your AOS is pending. You are using EAD so you need AP to be approved before you go out of US to reenter US. Apply AP and keep valid approved AP with you as you need AP from trip out side to enter US

Also when you switch to EAD from H1b how does INS is informed about your change??
--- just fill up Form I-9 with your employer USCIS/INS has nothing to do with I-9 it should be with employer HR

I have a followup Q:

I didn't apply for AP at the time when I applied for 485 and EAD since i didn't need to travel.

Now I need to travel and want to apply AP. Again I-94 is expired so am i ok to apply for AP with old expired I-94 and same for EAD renewal also.
Because I see that on AP INS don't ask for I-94# but on i-765 they do in 10th column "Alien Regn # or I-94". And i have A# which i think should be enough but I still wanted to discuss with you guys.

My lawyer is out so have to wait till she gets back but you input is deeply appreciated guys.
