This does'nt pertain to 485 but many people in thi sforum might benefit from the discussion.

A friend of mine works for a small company on H1.
His health insurance is covered by the company. One month the company did not pay the premium and the insurance company has canceled insurance coverage for all the employees.
My friend did not know about this
Now my friend has a bill for about $16,000 which the hospital wants him to pay.
What are his options?

If the expenses or treatment has taken when his/her isnruance is active then it is ok.

Generally hospital will take a reference number or authorization from the insurance when large sum is involved.

otherwise need to talk to hospital people and try to reduce the cost and have to pay by themselves
 
Hospital bill

To the best of my knowledge, the options your friend has :

1. Work out a payment plan with the hospital. As long as you show an effort to pay they normally would give you some flexibility.

2. If the hospital collection department refuses the deal , tranfer the case to Consumer Credit Counseling Service (CCCS) and have CCCS handle your account. The cost is free.

3. Borrow money from a financial institution such as bank or debt consolidation company. Of course, they'll charge interest.

4. The most extreme measure is bankruptcy filing but this is the VERY LAST OPTION !

If the insurance company cancelled the policy for nonpayment of premium by the employer, you do not have any case against the insurance company.

However, if health insurance was a benefit that was part of the offer of employment (or other written policy of the company), you could consider filing a civil suit against the employer for damages. If the company actually deducted the premimums from your paycheck (many plans have the employee pay part of the premium, the rest being paid by the employer) and/or did not inform you of the cancellation of the policy, you may have a strong case.

Unfortunately, as others have indicated, you may still owe the hospital their dues.

Yes health insurance was part of the package and some money was deducted from his pay check to pay for the same.
It was a mistake that his company missed one payment. They realized the mistake and payed the insurance company to reinstate the policy but that wont cover the bills for the time it was inactive.
 
Guys,

Usually if the company misses one bill to pay and insurance company discontinues your insurance policy, Employer can always
pay up the previous balancce and reinstate the policy, i have seen such cases, and you are good to go, but the deal is if
your employer has done this on purpose and refuses to pay
the balance; then you might have to deal ii with an attorney or an experienced person
