# AILA has reported that the Senate Judiciary Committe is markedup a
very important legislative bill on October 20, 2005, coming Thursday,
to discuss the Budget Reconciliation and Immigration proposal that can
give some relief to the current H-1B blackout and EB immigrant visa
number retrogression. According to the AILA, the proposal includes the
following:

> * Recapture of 300,000 unused H-1B numbers
> * Recpature of 90,000 unused EB immigrant visa numbers
> * Exempting spouses and minor children of EB principal aliens
from the annual EB quota limit
> * Permit filing of I-485 even during the visa number retrogression.

The H-1B Blackout: Many business, scientific and research organizations are being blocked by current law from accessing skilled professionals who enter the U.S. on a temporary basis through the H-1B skilled professional visa program. This blackout started almost two months prior to the beginning of the current fiscal year when the FY2006 allotment of H-1B visas was exhausted. This is the second year in a row the cap has been reached, and the seventh time since 1997.

My company has been severely impacted by the unavailability of these skilled professionals. (BRIEFLY NOTE THE NEGATIVE IMPACTS ON YOUR COMPANY.)

Lengthy "Green Card" Backlogs: Highly educated and skilled workers are stuck in long "green card" backlogs that will make it unlikely that they will become U.S. permanent residents in the foreseeable future. These employment-based immigrants already have been found to serve the U.S. national interest because of their "extraordinary ability", their advanced professional degrees, or their internationally recognized achievements. These long delays and backlogs mean that it will take many years before many will be able to adjust their status to permanent residence, a fact that severely disadvantages America and advantages our competition, foreign companies that actively seek out these employment-based immigrants.

This is definitely a good chance..
- Recapture of unused visas
- Removing dependents from the visa pools

should give a big boost.

I hope more people are reading this and contacting the senators.. This is the big chance in the immediate horizon.

There is some poison in the bill as well.

Look at the following:

Permit filing of I-485 even during the visa number retrogression.

This will make labor substitution possible due to AC21. Lots of older LC will be on the market to sell. All these people will be ahead of us.

Labor subst. would continue to happen anyways irrespective of retrogression or not unless they come out with some rule restricting\prohibiting it.

People now realize that PD matters and that dates could fluctuate wildly.

I will be happy if the increase in numbers make 485 Current\close to current. Better that this happen soon as backlog reduction will continue to add people to the "eligible for I140-485" pool. These eligible applicants have to get their I140 cleared and also go through the "name check" process.

On a different note,
I think the recapture of 300,000 H1Bs would cause quite some problems for people in consulting field. Body-shoppers would go wild and mass-get people. Their resumes would be faked to show US experience and references, and you now have a huge pool of consultants looking for projects and thereby driving down the rates.. hmmmmm

It is best to call: call the person in charge of immigration matters in the office of the senator. Their job is to listen to you !!
