IMP.: Indian Citizen born in Libya

Hello Friends,

I am an Indian Citizen and was born in the country of Libya in 1982. My dad was working there at the time and we lived there until 1993.

I never held a Libyan passport and was never a Libyan citizen (they dont have the rule of giving citizenships just coz u were born there). I have always have had a Indian passport since I was born.

But when I fill my applications for any purposes, including Green Card, I have to write Country of Birth as Libya. What affect (good or bad) will this have on my application? Will my wait time be less since my country of birth is Libya??? Please let me know.

Currently I am in USA on H1B and my spouse is on H4.

I think you will come under Libya quota.

For immigration purpose they consider country of birth.
Not where you live.

Arpit - I saw your post about your GC query and wanted to reach out to you. I have a similar case - I was born in Libya in 1985 and went back to India in 1996. Now am in US on H1B and my spouse is on a H4 visa. My company plans to file my GC (through EB3) by this April/May - Since you have already gone through this process I was wondering if you could help me with a few questions:

1) Do you know what are the current/priority dates for Libya?
2) If my application is completed by April, do you know how much more time would it take for a decision?
