Family law and immigration law are totally seperate from each other. It would only make a difference in a marriage based immigration case. If you have an H-4 spouse, that status would be lost.

Divorce while pending MOTIC case?

BigJoe, you raised a pertinent point. In my own case I've been waiting for three years now to get some response/resolution of my Reopened Case (before the Commissioner) on my application to remove condition- I was notified of that re-opening on 9th Jan 2008. And for records I got the CR1 (along with my two kids from previous marriage) in early2005.
My USC husband left me sometime late 2008 without any further contact since then, do you think there will be any impact on my case if I went ahead to divorce this man? Or any benefit? I'm in a difficult situation and worried about moving on with my life. We didn't have any children together and as it is now, also, no joint property ownership.
What's your advice?
Thank you.
