I have applied for my brother. His priority date is June 2007, so it will probably be another 8 years until he gets his turn. My question is can apply for a non-immigrant visa in the mean time? A visit visa, B? How about and investor E2 visa? He has always been an entrepreneur and has the money to start a little business. Or will he be denied due to his pending immigration case?

well you can apply for visitors visa but investors visa are pretty tough,you will have to show solid financial background with lots of paperwork showing you have big legitimate business back home.

He can apply for non-immigrant visas but it will be highly unlikely that he will be granted one. Only exceptions being H-1B and L-1A/B visas.
