I am British citizen currently going through the process of applying for an immigrant visa as a spouse of my wife, the U.S. citizen. Basically, seeing how alot of people on here seem to have knowledge of this sometimes confusing topic and some people have had experience in this area I thought I might aswell seek advice or get some feedback.
My wife had originally moved over to England to be with me over two years ago on a fiancé's visa and had her status adjusted to leave to remain 6 months later, however she has not settled well over here and wants to go back to the US hence us applying for me to get an immigrant visa for the states.
We had the initial petition approved and sent all the relevent paperwork back to the embassy in London, I also had my medical this week so we are currently awaiting on my interview being scheduled.
We can see no problems arising with my visa application. But, if possible we need abit of closure from people with experience in this field.
We intend to move back into my mother in law's address at first, whom is my joint sponsor. She has filed in an Affidavit of support and earns over the poverty guidelines etc. My wife is my main sponsor.
The issue's that Im not sure could be a potential problem are these.
My wife does not have a job lined up for when we would first get back to the states, nor do I. My mother in law has filed in an Affidavit of Support showing she is financially capable of supporting us until we find work.
We also have $8,000 in the bank, that will rise to closer to 12 over the next month or so. We are using this in my wife's avidavit of support as assets.
We will be looking for work on any level when we first get into the states.
My other issue is this, I unfortunately had to resign from my old job in July as my old employer's knew my wife had not settled well and we intended to apply for a visa to move to the states. Upon discussing this with my old employer's, we mutually thought it best to give them time to advertise and interview for the position over the course of the summer. Now, since then I have only worked a few shifts and have struggled to find work in the city we live in, I am pretty confident I can find temp work over the next couple of weeks.
Will this period of unemployment be frowned upon by the consular officer's?
Since I have been able to work, I have always been employed, paid tax, never claimed any benefits etc. My wife is currently supporting me, again I will not claim benefits.
I am an honest citizen with no convictions whom just wants to move accross the pond to where my wife will be 100% happy, from what I have said do you see any potential issues with our case?
Also, out of interest how long do you think it will take for my interview to be scheduled? I read somewhere to allow three months after filing the last paperwork, is that true?
