Immidately please reply < 180 days

Hi I need an advice immidately. I got laid off on 15th Feb. Got my EAD and my Reciept date is 14th Nov. So only 95 days completed.
Now I got an offer from different company with same job description. Can :
1. Can I accept new offer?
2. My previous employer is not willing to revoke my GC but by joing the other company will it affect my GC.
3. You never know but I think my case will not be approved in 180 days. But worst case if it approved in 180 days what will happen if I am not with my GC employer. ?
Please reply soon . I have to give reponse for the new offer this weekend.

Other centres TSC/VSC/NSC are taking the view that if the GC adjudication is done after 180 days then person is okay even if he has changed jobs before 180 days.

CSC is taking the opinion that person should change jobs after 180 days.

You can do two things

a) Change jobs and hope that an rfe is not generated, or even if rfe is generated ur lawyer fights the case and it gets approved.

b) do not work between period from now till 180 days are over and then find a job and if u get rfe say that u were jobless for the period between and then found job after 180 days and technically speaking u will be okay. You are not considered out of status if u r not working.

Of Course do consult a lawyer before taking any action.

I have done my FP in san jose today ahead of my schedule,

I lost my JOB before 180 day\'s and by January my 180 day\'s are over.

am i safe if i find a JOB... please help.. my employer will not inform INS about layoff...
 
Another point of view

CSC is approving cases where the person
changes job before 180 days. Several people
posted it happened to them. Since you were
fired, you can argue your intention was to work
for sponosring company but due to economic
down turn they fired you. If you read the AC21
memo, it says 180 days from adjudication, so as
long as you don\'t get adjudicated before
180 days you will be fine.

However, many people who changed jobs before (and after) 180
days filed a H1 transfer and joined new job
on H1 transfer. Remember, the new rule says you
can join after H1 is filed and receipt received.
The reason for doing this is because if the AOS
is denied, you can continue working
otherwise, if you join on EAD card, then if you
AOS is denied your EAD card is void and you won\'t
be able to work.
