I am waiting for my I-140 to come thru and my 6 years of H1 is getting expired next month(Jult 2002). My I-140 was applied with a (substituted) someone else\'s pre-aproved labor cert which has a filing date well before 365 days of my 6 yrs of H1 expiry date.
Can I in this situation apply for the 7th year H1 extension? Does it matter if I used a pre-approved labor cert instead of mine(which is also applied but just 9 months prior to my H1 expiry date hence probably not qualifying me for the 7th yr H1 ext).
Also the filing date for the pre-approved(substituted) labor cert is even before my joining date in this company.
Prompt help is really appreciated.
