illegal alien marrying citizen

just want to know for a friend. i know that those that came illegally can't adjust status even if married to a citizen. and i also know that those who came legally but overstayed can adjust if they marry a citizen. and i also know that those you came illegally or legally got to put in for status under 245i and just pay a fine of 1k and not have to return to their country.

the question is, does those who came here legally and overstayed and marry a citizen have to pay the 1k? i know that if they were part of 245i they must, but what of those who aren't? what of that international student that came last year and is now illegal and marries a citizen?

no. As long as he/she doesn't leave the States until she/he gets his/her GC, the illegal presence will be forgiven at the interview.
 
my friend has to give me more info, but he says his lawyer says that al lhe has to do is pay the fine. as far as i know, my friend isn't under 245i or any other petiiton. and as far as i know, the 1k fine is for 245i people only. and you confirm this.

so why is his lawyer bringing up the fine? will ask my friend further details about his case. could the lawyer be mistaken or know they can adjust and putting in false hopes and get soem fee and then run away with the money? i am under the impression my friend came illegally and isn't under 245i. will make sure about this. when he told me about the fine alarm bells went off.
 
If he entered legally but overstayed, USCIS usually "forgives" the immigrant. He does not have to pay the $1,000 fine. Even if overstay is over 480 days.

If the lawyer is telling him that he need to pay $1,000 and he doesn't qualify under section 245(i), then he is paying the money to the lawyer, for his own pocket. The lawyer can't be mistaken, he's just looking for extra money from your friend... slam balls.... :rolleyes:

You friend, if he came illegally, there is no future for him, unless BUSH pardons all illegals while pardoning Scooter Libby, he is screwed... :eek: As for that lawyer, he needs to flee from that lawyer, he is a thief and untruthful... lack of knoweldge and information, doesn't make you retard.
