hi everyone,
i am going to face IJ for individual hearing in my reffered asylum case..what is the role of the attorney of mine and the trial attorney?i mean ,who will get previllege in the court?please share your experience.thanks in advance.
 
Your attorney has to prove to court that even though you are removable you qualify for asylum on the protected grounds. The DHS attorney has to prove the contrary though it very often that they just let the judge do all the talking as they dont really care about the outcome. The Judge is who you should be worried about for the most part as some are lenient and some are very nasty.
 
Hi guys,

A friend of mine and his mother were referred to IJ for their asylum cases. This IJ is a typical IJ who loves to pending cases for few years. The IJ would tell them to come to a hearing and make another hearing date or reschedule another hearing. They were currently in the individual hearing. A few days ago, the IJ told them to take biometrics (fingerprint) again, even though they already had their biometrics taken after they filed I-589 application in asylum office. My question is what does this imply? Is that mean the IJ gonna grant their cases? Anyone has similar experience like this?

Judges actually don't like to have a lot of pending cases, as they are also kinda pushed to make decisions as soon as they have all the info on your case, like fingertips and background cleared etc. Biometrics are only good for 1 year btw, so that is probably the case here. Doesn't mean he's gonna grant the asylum, doesn't mean he's gonna deny though, they just can't proceed anyhow if they don't have current biometrics 'cause of the Real Id act.

In very rare cases judges really can grant the asylum without the background check cleared, in fact that how i was supposed to get mine, cause INS was taking forever for some reason when it got to presenting this info at the court, so judge said that at the next hearing date he's gonna approve no matter what (my asulym was granted at the individual hearing waiting for background clearance, had to wait more than a year to actually get approved, btw :)
 
bonita, this judge is a typical judge who is well known for pending cases for YEARS. A lot of my friends got this judge and got the decision at the fastest 2-3 years, some even got the decision over 5 years (according to a lawyer). If biometrics are valid for only 1 year, then every asylum applicant who is referred to IJ by AO (as most IJs decide cases in more than 1 year after filing of I-589), has to do SECOND biometrics. Are u sure of the 1 year validity of biometrics? Thanks
 
That is something I learned from my lawyer, had to go through the whole fingerprinting procedure like 3 or 4 times over the past 5 years myself :)
