If L-1 Visa Holder gets fired please HELP !!

Hi,

I am on L-1 visa, which is valid till april 2007.My company has applied for extension through premium processing.

Because of a misunderstanding, I might be asked to leave in next few days.

My fiance' got her H-1 approved last week.

We are getting married in jan in India.

Before I apply to other companies and they process my H-1 in April 2007, which shall be effective in October 2007...I wanted to ask this : Till how long can I stay in US, if my company fires me ? am really worried please help me ASAP..wont be able to sleep till i see an answer from you guys....my sincere request, please help me
 
Unfortunately, there is no grace period for L1 visa holders like H1 visa holders. L1 visa holders are intracompany transferees and the basis of their presence in the US is solely based on employment with the sponsoring company. If the company fires an employee who was transferred previously from another branch of the company overseas, he is expected to leave the country immediately.

This is in fact a grey area since immediately does not necessarily mean the same day. However, an L1 employee who is fired is expected to leave the country asap. Generally, if one leaves within a few days (3-4), that should not be a problem.

I would recommend that you sort out any misunderstanding with your sponsoring company.

get married today. then file a Change of Status petition I-539 form with USCIS to change from L1 to H4. This will entitle you to remain in the US in legal status while the H4 adjudication is pending. Of course you will not be allowed to work. You would have to get your own H1 in order to work.
