If i-EAD is not issued at local office

If the INS - Texas does not approve EAD within 90 days and your local office doesn't issue the interm EAD. What are the available options for getting EAD ?

Options if EAD does not arrive...

1)Just wait and wait
2)Re-apply for EAD fresh
3)If card approved and did not recv then apply I-824 (will take very long) or reapply.


Also make sure the post office know that u and ur spouse(if u have one) will get the mail at ur address
also write a name label on the mail box of all the names who recv the mail.

Extension of EAD

It is advisable to apply for your extension more than 90 days before your current EAD card expires because if an EAD extension is not approved within 90 days, it is automatically extended for 240 days, or until a decision is made, whichever comes first.

If it is not extended within 90 days, you can also go to the nearest INS district office and obtain your extension right away.

Procedure for filing the extension of EAD is same as new EAD, except that you should provide the copy of old EAD while renewing it. "

I was replying to the question that if EAD does not arrive and Local INS cannot issue one....

I am not sure buddy...

But in my case...My spouse Ead never arrived...that was the reply I got when i called INS (from the IIO)..which I summarized in prev reply.

Me and My Wife applied for our first time EAD and AP with same REceipt Date , Sept 11 02 at TSC

My AP got approved on Nov 19th and EAD on 23rd Dec and I have my EAD card also now.

For My wife neither AP nor the EAD is approved. The online status system has no update, called IIO and they say different answer everytime.

This week they said only now they are dealing with EAD and AP cases for Spouses(dependents) for people who have filed in Sept 2002. Asked me to wait for another 3 - 4 weeks.

Do not know why they say 60 - 90 days and delay us all so much.

If local INS refuses, apply with the nearest district office. (search in INS website- field offices)

When you apply for interim EAD and the officer says it is refused, most people dont get it in writing.

Yes, if interim EAD is refused , get it in writing (have a letter typed ready which states that today's date is beyond 90 days from EAD/AP and local or district office commissioner refuses to give interim/emergency doc on such and such date)

If you have a lawyer, ask the lawyer to stand with you in the Q...
