Hi All,

Assuming I-485 is denied, and you decide to go back to your home country....is there any chance at all to come back to US as a non-immigrant?? be it on H1 or L1 or any other non-immigrant category!!!

Thanks,
RC

If you haven't been out for more than a year and you still have time left from the 6-yr limit, you can get back for the remaining time on an h-1b visa based on an approved petition filed by a US employer.

AOS rejection shouldn't have any bearing on H or L visa eligibility, as far as I understand.

It depends on the reason for the rejection. If you're rejected on the grounds of inadmissibility, that may prevent your readmission in a non-immigrant status.

But ofcourse! and having a prior AOS rejected might affect counselor's decision on granting a non-dual intent non-immigrant visa too!

Whatever the reason for the rejecting I-485, does the person has no way of coming back to the US as a non-immigrant?? (assuming he left the US for his home country and then tried to come back on a H1 after couple of years!!!)

Thanks,
RC
