If H1B extension is rejected does it effect my I140 application.

Hi All,

I applied for my I140 and I 485 concurrently in June'08. I have received an EAD based on my pending I485. I know if my I140 gets rejected my EAD gets cancelled.

However, My firm is having difficulty getting H1B extensions approved. My I129 got rejected.
Now my choice is to use my EAD and pray that my I140 is approved or leave my firm and join a new company by transferring my H1B.

I just want to know does anyone know if there will be any effect on my I140 application due to my I129 rejection. I have a feeling my I129 rejection has to do with my company filling for to many H1b visa, no one in the company is getting i129 approval. If so does that also effect my GC processing.

Basically, If my GC has very little chance of passing through my company then i might as well leave. I just want to whether H1B extension rejections can lead to GC cancellations.

Anyone have any idea?
 
your h-1 and greencard are seperate process even with same employer.

You can use your ead to keep working for your employer and wish that 140 will get approved.

You can also file for h-1 through another company and have your current employer contiue your greencard process.
