If employer cancel i140??????

Hi all,

Can any one tell me that after completion of labor and i140, if suppose someone want to change the company and try to use the approved i140 and apply by using another attorney by paying the fee from their pocket .

After applying for i485 if employer cancells the approved i140 without intimating the employee(who is already not working for that company)?????

What should we do in that case???

as far as i know

I485 is applied on basis of I140. If old company cancels I140 in less than 180 days of application of I485, then your chances of getting I485 approval are slim. The company owns I140, but after 180 days of I485 application, the appication becomes independent of employer as long as the job is of similar description. I found out on this discussion board that murthy fought for a I485 after I140 was cancelled by employer, but since 180 days had passed before I140 cancellation, INS eventually approved the case. Keep people at your old company in good humour, make sure they dont cancel your application.
