if applied COS H1->H4,cudnt provide paystubs,gets denied,have to go to india-any effects in future?

Hi Every one

I need your suggestions and advice.

I entered US on H4(valid til july 2009) and got my H1 in october 2009(no jod no paystubs)

i wanted to changes my status from H1 -> H4 in US

I heard that these days they have been quiries are they are asking for paystubs

as i have no paystubs what will happen if i dont provide them with paystubs during change of status...they might deny it

so what next...do i have to go back to india?

my question is that will it effect my Life in future...any problems while filing for greencard or etc...wil there any kind of problems for me or for my husband in future regarding anything?

You have not posted enough information. Why were you not on a job etc... do you still have a valid H4 visa etc..

1. If you were on H1 and were on bench and were not paid, speak to your employer and ask him to pay you as per your LCA.
2. If you were not well ,or had some other valid reason for leave you can use that and get on to a job, or use that and change status to H4.
3. If you have a valid H4 you can leave the country and enter again.

To understand the best answer in your scenario speak to an attorney.
