IEADs less than the 90 days requirement

Came across one instance in this site when someone actually visited a local/district INS office (Sacramento), and got an iEAD after the original I-765 had been on file at the INS service center (California) for less than 90 days (Mind you this is not for asylee based but for regular AOS). I am curious, but is anyone aware of any such unique occurences elsewhere in the US?

Secondly has anyone applied and received an iEAD in Tampa, FL?

depends on the district office. As far as I know tampa is not a district or sub office. You can try in miami, but 90 days is strictly followed in most of the TSC district and sub offices...
 
Jaxen, Tampa is closer to where I live, and is also a sub office. I know for the initial EAD you always have to apply at the service centers (where your I 485 is in file), but would you or anyone in this site know whether you can get a RENEWAL of your current unexpired EADat the local BCIS office. Thx
 
EAD renewal

No, you still have to apply where the 485 is pending. But you can go and get the interim EAD after 90 days of the EAD application receipt date from a district office.
 
For the benefit of the users of this site, especially relating to questions on EAD renewal, there are few things you need to know to enlighten yourself. I have noticed in this site as well others, that EAD questions on this subject may have been incorrectly answered or addressed.

Relating to EAD renewal, you can apply for an EAD directly at a local INS office, if the expiration date on your current EAD card has sneaked up on you. When I say this I do NOT mean an iEAD.

It makes sense when you apply for your AOS at a BCIS Service Center, that you apply for the EAD and AP at the same place concurrently. After that when you have to renew your card, and you have plenty of time in your hands, maybe like 5 months or more, sure you can apply from the service centers. But for some of you, who do not have that luxury, and your EAD is expiring next month and you do not have an EAD renewal application on file at one of the service centers, try to get your EAD from the local office, but do contact the local office and talk with an immigration officer first, and maybe set up an appointment.

This is my experience so far. After reading the guidelines on where you can and cannot apply for renewing your EAD, I called up the Tampa sub office, and I was very explicit in conveying what I wanted, and took pains in explaining that this was an EAD renewal based on pending AOD, ELIGIBILITY UNDER 8 CFR 274a.12 C (9). She asked me if my EAD is expiring at the end of the month, I said no but in June, and she gave me an appointment for May 5th to get my EAD renewed.

Just so that we were on the same page, I asked her and she told me that I do not have to apply to Texas Service Center to get my EAD renewed, but go to the Tampa sub office.

I would double check that....
As I am aware, we have been caught in the homeland security process, where the renewal are no longer being done in the local INS office. I had personally visited the local INS office in Dec and I was turned down saying, they no longer do renewal at local offices and all application should go to regional office.

Check the INS web site to see what the procedure is for EAD renewal.

If you are right, I would like to fly down to FL and take my chances.

lachit, the regulation you talk about does not guarantee EAD. There are many other variables like family based GC, employment based GC, concurrent processing etc.
of course, it will be self evident to users when you attempt at the local office.
Please users post your experience with some specific dates so that there is some authenticity to your posts...
 
I spoke with someone at the National Customer Service Center yesterday, who insisted you can only submit EAD renewal at the regional center, but after listening to her comments on the 90 day rule of an iEAD, I realized she ABSOLUTELY has no clue what she was saying. It was all baloney, and I will never again waste my time calling the National BCIS. My personal take on thi issue is if you have specific employment based immigration questions, call the regional service center if you have to, or the local BCIS.

I spoke with an IIO at TSC today, and she confirmed that local BCIS offices are allowed to issue both EADs and iEAD on employment based I 485. She has never heard about any BCIS direction to the contrary, or anything that said you have to renew EADs ONLY at the regional centers.

I looked up the BCIS Web site on EAD processing. While they talk about filing EAD (in general) at regional centers, they DO NOT say anything as to where you can file your 765s for renewal. But the link to questions on to where to apply for EAD renewal (based on c (9)) when you go to download an I 765 form at the same site clearly say that you can apply either at the regional centers OR at the local BCIS.

curious...

although per ginnu's post about ASCs being taken out of immigration benefits picture is looming, I am curious as to find out anybody whose 485 was pending in a service center, applied for EAD/AP (non emergency, non interim) with the local ASC and got it?
In case you are confused about the wording that you can apply for EAD at the local ASCs, remember there are some categories of 485 applicants who can send their 485 apps to the ASC!

It is logical that you apply EAD at the place where your 485 is pending...
