Please follow IHP website closely. They update the system promptly once they receive 45 days letter. In my case they took 1 week to communicate to my manager that too after me sending the mail checking status on 45 days letter. The fun part was when they responded they mention that they were waiting for my manager's approval but the truth of the matter is they just sent the email to my manager after me sending the email. Still they have not updated anything regarding the response which tells me that they have not responded to 45days letter. I was so disappointed with the sloppiness of Fragomen.

I am so happy to see the forum for IBM labor. My labor filed in the month of october 2003. Till today no status about 45 day letter or approval. I believe it is in Dallas because it is filed in Indiana.

Another issue is, when IBM is going to refile in PERM?

Please share your experiences.

IBM Immigration attorney's already strted filing Perm. They initially were trying to schedule conference calls with employees beacuse it was time consuming they had a web cast regarding the perm option. The key is your manager should support this. As long as you have your manger approval Fragomen will be more than happy to file perm application. The reason why most of us did not go for perm was because there is no guarantee that we will be able to retain the old Priority date.
 
45 day letter responded.

It took almost 3 weeks for our attrneys to respond to the 45 day letter.

45 days letter received: 03/13/2006
45 days letter replied: 03/1/2006

It was updated in IHP website today.... :mad:

So, is it good idea to file in Perm or not? My case was filed in EB3 NON-RIR.

Send a note to Fragomen that you want to go for Perm. Please discuss with the attorney's about pro's and cons of going perm. If evererything goes well you may be able to retain your priority date. Though now they dont guarantee that. Worse come worse you may loose your priority date of 2003 but atleast get your labor cleared. If the new proposed bill gets passed then may be you can even file for 485. Good luck

I came to know that my manager received 45 day letter from Department of Labor yesterday. I just completed listening webcast and sent an email to fragomen for conference call for refile in PERM.

Now I dont know what do. What is the approximate wait time for approval after 45 day response? Is it a good idea to refile in PERM at this time?

Stat1 - Observing the forum, the approval can be somewhere between 3 months to 1 year. Its so widespread that no particular trend could be established. Filing Perm takes about 6 months with Fragoman. If you are EB2 and have a old PD, I will suggest stick with your old labor. If your P.D is later than 2004 then may be its worth while doing perm and get atleast labor certified.

Mine was EB3 and filed in October 2003. So what will be the best?

Currently for EB3 Retrogression date is March 2001. The dates are just jumping by one month at a time. Say you didnt go for perm and stayed with your current labor, your labor may get cleared before September 2007. This is the date that DOL has posted in their website for clearing their backlogs. I am seeing approvals now July 2002 for EB3 RIR cases considering these things it looks like your labor may get approved some time mid next year. By doing that you are certain that you are going to have a P.D date of Oct 2003. Say retrogression is moving one month per month it will have a Early 2002 date. Still you may have to wait to file for 485. with this route you get your labor next year and will put you ahead for filing 485.

The next route is apply for Perm, to apply for perm it takes 6 months plus processing time that will get your labor sometime next year. With this route you are not certain whether you will retain your P.D. which means your P.D will be 2006. This make you wait minimum 2 to 3 years to apply for your 485.
That is if everything remains same. If senate passes law which allows people to apply for 485 irrespective of the P.D then you will be able to apply as soon as you get your labor. But that is still up in the air.

In my opinion by applying for perm I am not seeing a significant time difference in getting your labor. If I were you, I will probably play it safe than sorry becoz 3 years wait time is a lot to gamble. Please consider all the pros and cons with the attorney's before you go for perm. Good luck:)
