I94 return & TN renewal

Good morning, I just have a Couple questions:

We are going out of the country for a couple weeks so that we can renew our TN/TD and enjoy a little vacation. Our visa exp date is October 28, 2010 and so is our I-94. The reason why we are going 4 months ahead of time is my employer is pushing me to do it during the summer (slow season) since we have scheduled some serious work load for the fall. Anyways, here are the questions:

1) In the event that my renewal is denied (considering this possibility), What happens to our actual status? Will it be canceled or will it keep valid until it's expiration date?

2) Do we have to return our I-94s when leaving the US? even do it's only for a couple weeks just to go and get our visa renewal? If yes, and in the sad scenario where my renewal is denied, will I be able to get my I-94 back for the first approved status period?? This is so that at least I can come back and finish my current contract.

Any help will be appreciated.

1. In the likely event that the CBP officer will merely say that it is "too early, come back in October", then this is a non-event, you enter on your current status, just like every other time. This will not be a "denied" renewal, it will be an "ignored" request for early renewal.

2. You keep your I-94s. Even if for some reason the would be taken as you left US, the I-94s that would be reissued would be based on your current status (you always carry proof of your existing I-94)
