I94 question

gurus,
my current visa and i94 is applicable untill 22 oct 2003. the visa has been extended till dec 2005 and i have received the approval notice and the new i94. however i had clipped the new i94 on the passport and it was removed by the airline staff when i flew outside the country on a short visit last week. while coming back i was given a i94 valid till 22 oct 2003 ( depending on the visa stamped on the passport )
i would be visiting india on 1 nov 2003 and will be getting the extention stamped in mumbai. Do i have to ask the bcis guys to gimme a new i94 valid till dec 2005 or will it be ok with the i94 valid till oct 22 2003.

--- ------It is mistake of BCIS Inspector at POE if you showed passport visa AND new H1 approval with you were supposed to get new I-94 till December 2005.
------- ----Your stay after 22October2003 will be Illegal, get it fixed by visiting Local BCIS immediately and talk to your lawyer
 
Out of Status / In Status - Advice Please

I have been working in the US since 1998. I went to India in November of 2002 and came back in January of 2003.

I had my Visa Stamp on my old company which was valid till July 2003. My H1B Petition with them was also vaild till July 2003. My H1B petition of the company where I was/am working is valid from July 2002 to April 2005.

I came back to the US on my Old Company Visa Stamp. I showed them the Old Company Petition as well as my New Company Petition. The INS officer at the Port of Entry (Los Angeles) entered the End Date of my Old Company H1B Petition (July 2003) on the I-94 card by mistake instead of entering the end date of my New Company H1B Petition (April 2005).

Today I wanted to apply for my Visa stamp extension and noticed that my I-94 is expired. My friends are telling me that I am out of status from July 2003.

Can you please let me know if I am really out of status though I have a valid H1B petition till April 2005. If I am out of status what can I do to retain my original status. Also is there any other way I could renew my I-94 without leaving the country.

I am also applying for I-140 and I-485 through a third company. Will the I-94 expiration cause me any problems.

Any kind of help/suggestion is highly appreciated.

Since ur I-94 expired in july - u are out of status from July.
Being out of status will create problems for Green card - so get a new I-94 immidiately.
Also talk to ur lawyer.
 
I-94 still valid in old passport

I have the opposite problem. My i-94 in my old passport was stamped until 2005 based on my new H1 visa which is valid till 2005. I just renewed my passport. What should I do since the I94 is in the old passport?
 
Garp:
Staple the new passport with old passport and keep both the passports attached, you may have to show both the PP when you re-enter US
